Η μητέρα υποστηρίζει ότι η παρέκταση της δικαιοδοσίας των δικαστηρίων ενός κράτους μέλους βάσει του άρθρου 12, παράγραφος 3, του κανονισμού 2201/2003 ισχύει μέχρι να τελεσιδικήσει η δικαστική απόφαση που εκδίδεται στη συγκεκριμένη υπόθεση και δεν εξακολουθεί να ισχύει μετά το χρονικό αυτό σημείο. Η μητέρα θεωρεί επίσης ότι το άρθρο 15 του κανονισμού 2201/2003 έχει εφαρμογή σε συγκεκριμένες μόνο υποθέσεις, οι οποίες εκκρεμούν ενώπιον δικαστηρίου κράτους μέλους, και όχι γενικά στη δικαιοδοσία του δικαστηρίου αυτού, οπότε, αν δεν υπάρχει εκκρεμής υπόθεση, δεν τίθεται ζήτημα παραπομπής κατ’ εφαρμογή της παραπάνω διάταξης.

The mother submits that a prorogation of the jurisdiction of the courts of a Member State under Article 12(3) of Regulation No 2201/2003 continues until there has been a final judgment in those proceedings, but not thereafter. In addition, the mother submits that Article 15 of Regulation No 2201/2003 applies only to specific proceedings, pending before the courts of a Member State, and not to the jurisdiction of that court in general, so that, in the absence of pending proceedings, there is no case to be transferred under that provision.
